Terms of Service

1. Acceptance

By accessing or using Smeltcore (the "Service"), reachable at https://smeltcore.com, you agree to these Terms of Service. If you do not agree, do not use the Service.

The Service is provided by Vadim Liavitski (the "Operator", "we", "us").

2. The Service

Smeltcore is a community-curated catalogue of benchmarks for running open-weights AI models on consumer hardware. The data is collected from public sources and community submissions, and reviewed before publication.

The Service is provided as-is, on a best-effort basis. We do not warrant that any benchmark accurately predicts performance on your specific hardware or software stack.

3. User content

When you submit a benchmark, a comment, or any other content (collectively "User Content") you:

  • Affirm you have the right to submit it.
  • Affirm the data you submit is accurate to the best of your knowledge.
  • Grant us a worldwide, non-exclusive, royalty-free, irrevocable license to publish, modify (for formatting / fact-correction), translate, and distribute the User Content under our published license — currently CC BY-SA 4.0.
  • Acknowledge that contributions are moderated before publication and may be edited or rejected.

You retain all rights to your original benchmark data; this license only governs how we display and redistribute it.

4. Acceptable use

You agree not to:

  • Submit knowingly false benchmarks.
  • Submit content you do not own or have permission to publish.
  • Use automated means to scrape the Service beyond what robots.txt permits.
  • Attempt to disrupt the Service (DoS, exploitation of vulnerabilities, etc.).
  • Use the Service in violation of any law applicable to you.

We may suspend or block access without notice for material breaches.

5. Intellectual property

The benchmark dataset is licensed under CC BY-SA 4.0. You may re-use, re-mix, and republish entries provided you (a) credit the original source link, (b) link back to the corresponding /check/ page, and (c) license your derivative work under the same terms.

The site's source code, layout, and trademarks ("Smeltcore", logo) remain the Operator's property and may not be re-used without permission.

6. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We make no guarantee about the accuracy, completeness, or usefulness of benchmarks. Do not rely on the Service as the sole basis for a hardware purchase or deployment decision.

7. Limitation of liability

To the maximum extent permitted by law, in no event will the Operator be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill arising from your use of the Service.

The Operator's aggregate liability for all claims arising under these Terms is limited to [€100 / $100 — pick a nominal cap].

8. Indemnity

You agree to indemnify and hold harmless the Operator from any third-party claims arising out of (a) your User Content, (b) your breach of these Terms, or (c) your violation of any law or third-party right.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, for any reason — including breach of these Terms.

Sections 3 (license grant on User Content), 5, 6, 7, 8 and 11 survive termination.

10. Changes

We may revise these Terms. Material changes are communicated by bumping the LAST_REVIEWED date at the top of this page. Continued use after a change constitutes acceptance.

11. Governing law

These Terms are governed by the laws of Poland, without regard to its conflict-of-laws rules. Any dispute is exclusively subject to the courts of [VENUE — typically the operator's principal place of business].
